Terms and Conditions
- General
These general terms and conditions apply to the entire offering made available by MC2MC vzw, with its registered office at Dreefstraat 7, 9260 Wichelen, and company number 0805.366.353, for the event MC2MC Connect (hereinafter: “Organizer”), unless expressly agreed otherwise and to the exclusion of the terms and conditions of the contracting party (hereinafter: “Customer”). Persons who have not purchased a ticket but can still be considered as ticket holders are referred to as “Ticket Holders”.
- Order
The Customer expresses the intention to make a final purchase and thus place an order by requesting this via the website or directly via the run.events platform.
By placing the order, the Customer declares to have taken note of: (i) these general terms and conditions, (ii) the code of conduct established by the Organizer, and (iii) any special modalities and conditions that may be mentioned on the Organizer’s website.
An order can only be made through the external ordering platform run.events or by requesting an invoice as an annual or event sponsor.
The Organizer reserves the right to refuse or cancel orders in case of indications of fraud or irregularities.
- Price and Payment
If the Customer places an order via the run.events platform, payment must be made through this platform and its payment system. In any case, purchases are immediately payable. If the Customer chooses to pay via bank transfer, the Customer will receive an email with the necessary information to proceed with the payment. Tickets will only be made available after the full amount has been paid and will be invalid without full payment.
The purchase price may be increased by service, shipping, and/or transaction fees. Such fees will be displayed at the time of the order. The purchase price includes catering.
Purchased tickets may not be traded or resold at a higher price.
Invoices are payable at the latest on the due date mentioned, at the address of the Organizer.
When an invoice is not paid on time, a late payment interest of 10% is automatically due by law, without any prior notice of default, as well as a fixed compensation of 10%, with a minimum of €125.00. This provision does not exclude additional compensation for damages. Late payments will first be applied to the interest and fees, and only then to the principal amount.
Any dispute regarding an invoice must be made by registered letter within 8 calendar days of receipt, to the registered office of the Organizer.
Any dispute against an invoice must always be explicitly motivated. Depending on the circumstances, a dispute does not automatically entitle the Customer to withhold payment of the entire invoice.
- Delivery
The delivery of tickets is always done electronically, unless expressly agreed otherwise by the Organizer.
The Customer will receive a link to the e-ticket; however, it is important to review the terms and conditions outlined in Article 3.
The Customer is responsible for the validity of the provided email address. The Organizer is not responsible for the operation and security of the Customer’s email program. The risk of ticket loss transfers to the Customer at the moment the email is delivered to the Customer’s provider. The Customer is responsible for checking email messages, including those in any ‘Junk (SPAM)’ folders.
- Right of Withdrawal
When purchasing tickets, the Customer does not have a right of withdrawal.
The Customer cannot exercise the right of withdrawal in accordance with the Economic Law Code, as the event is organized on specific dates.
- Refunds
Tickets will not be refunded or exchanged in the event of loss or theft.
In exceptional cases (such as force majeure), the event may be rescheduled. In such cases, the Customer will be offered ticket(s) of equivalent value to the original tickets. A Customer who qualifies as a consumer under Article I.1, 2° of the Economic Law Code may opt for a refund, which will be processed as in the case of cancellation.
If the Customer cannot attend the rescheduled event and can prove this, the Customer—provided they are not a consumer under Article I.1, 2° of the Economic Law Code—may request a refund on their own initiative. The Organizer must be informed of the Customer’s wish for a refund within the specified timeframe. If not, the Organizer will confirm the booking for the new date, and the Customer will lose their right to a refund. Any such refund will be processed in accordance with the rules for refunds in the case of cancellation.
In the event of the cancellation of the event, a refund of the purchase price of the tickets will be offered, excluding shipping and transaction fees, and less any costs already incurred. If one or more (but not all) days of the event are canceled, only a partial refund will be issued corresponding to the canceled days.
In any case, a refund will be issued, notwithstanding the other provisions of this article, after deducting the costs already incurred by the Organizer.
- Cancellation
Early bird tickets are non-refundable. For regular tickets, the Customer may cancel, subject to a cancellation and administration fee, up to one month before the event. After this period, cancellations are no longer allowed, notwithstanding the provisions outlined in these terms and conditions.
- Liability
The Organizer’s liability shall not give rise to any compensation, except in cases of intentional misconduct or gross negligence by the Organizer, to the extent permitted by applicable law.
Liability is limited to direct damages and to the value of the purchased tickets.
The Customer is solely responsible for any mistakes made during the purchasing process, such as providing an incorrect email address or selecting the wrong number of tickets.
The Organizer cannot be held liable for actions, omissions, or other conduct of third parties, including advertising partners, sponsors, external partners, event participants, etc. The Customer may inform the Organizer about such omissions/actions by these individuals, after which the Organizer will investigate the matter at their discretion and may take appropriate action.
The Organizer also assumes no financial or other liability for any personal injury or damage, nor for any loss or damage to personal belongings during a visit to the event.
When the Customer purchases tickets on behalf of a Ticket Holder, the Customer is responsible for ensuring that the Ticket Holders are aware of these terms and conditions. The Customer indemnifies the Organizer against any breach of these terms by a Ticket Holder and for any damage caused to the Organizer by a Ticket Holder.
- Personal Data
To process and execute the purchase of tickets, the Organizer requires certain personal data. The data collected for this purpose will be processed and used in accordance with applicable privacy legislation. The Organizer acts as the data controller in this regard.
The Organizer will use the obtained email addresses for further communication as well as for sending commercial messages regarding similar and/or future events.
To view, modify, or remove your personal data, as a Customer, must visit your run.events profile.
- Intellectual Property
The logos and trademarks of the Organizer may only be reproduced and/or used with the prior consent of the Organizer.
The Customer and Ticket Holders may be filmed or recorded. By purchasing a ticket, the Customer agrees to this. Additionally, Customers are not allowed to make any recordings of the sessions without the Organizer’s approval.
- Access to the Event
Access to the event is granted only upon presentation of a valid ticket or badge. Each barcode/QR code represents a single access pass. The ticket can only be scanned once on the specified date. If the same barcode/QR code is presented multiple times, only the first scanned ticket will grant access to the event. Any attempt at abuse, forgery, or fraud may result in legal action.
Once a valid ticket has been scanned, the holder will receive a badge that grants them access to the event.
A ticket may be scanned digitally or printed on paper. Such a printout must be clear, and all elements must be readable without any possibility of confusion.
The Customer and Ticket Holders must keep their badge visible at all times during the event for safety reasons.
The following items are not allowed at the event: alcoholic beverages, drugs, fireworks materials, animals, weapons, sharp objects, etc. This list is not exhaustive. The Organizer reserves the right to prohibit any other items at the event venue.
Access to the event implies acceptance of all preventive and control measures taken by the Organizer or the security team, including the right to search individuals and bags.
Failure to comply with these measures may result in refusal or revocation of entry rights, without the possibility of a refund.
Any Customer, Ticket Holder, or participant exhibiting inappropriate and/or disrespectful behavior towards other participants and/or the staff/representatives of the Organizer may also be removed from the event, without the possibility of a refund.
- Force Majeure
The Organizer cannot be held liable for the consequences of force majeure, which can be defined as any event or circumstance over which they have no reasonable control, which was not caused by either party and which significantly hampers the further execution of the Organizer’s obligations.
An event of force majeure may include, but is not limited to, the following: natural disasters, armed conflicts, social unrest, criminal acts, epidemics, accidents, power and telecommunications outages, government intervention, economic factors, etc.
If the Customer wishes to cancel the purchase of tickets (and this can no longer be done free of charge) due to force majeure, the Customer will be required to pay compensation equal to the costs already incurred by the Organizer. These costs are estimated at 25% of the purchase price of the tickets, without prejudice to the Organizer’s right to demonstrate actual damages. If the Customer qualifies as a consumer under Article I.1, 2° of the Economic Law Code, cancellation due to force majeure can always occur without the payment of compensation, notwithstanding what has already been stated in these terms regarding refunds upon cancellation.
- Code of Conduct
The Organizer has a Code of Conduct that the Customer/Ticket Holder must adhere to.
This Code of Conduct can be consulted on the Organizer’s website.
- Disputes
The invalidity of any (part of a) provision shall not affect the validity of the remaining (parts of the) provisions.
The courts of the district where the Organizer’s registered office is located shall have exclusive jurisdiction to hear any disputes, subject to any mandatory legal provisions.
Belgian law shall apply.
